काठमाण्डु – सत्तारूढ चार दलिय गठबन्धनले व्याख्यात्मक टिप्पणीसहित एमसिसी संसदबाट अनुमोदन गर्ने निर्णय गरेका छन् । प्रधानमन्त्री शेरबहादुर देउवाको प्रस्तावमा माओवादी केन्द्र, जसपा र एकीकृत समाजवादी व्याख्यात्मक टिप्पणीसहित पारित गर्न एमसीसी संसदबाट अनुमोदन गर्न तयार भएका हुन् ।

सरकारले एमसीसी सम्झौतालाई संसदमा पेश गरिसकेको छ । आजै संसदबाट प्रस्ताव पारित गर्ने तयारी छ ।

यी हुन् ब्याख्यात्मक टिप्पणीका ११ बुंदाहरु-

Acknowledging the clarifications received by Nepal from the Millennium Challenge Corporation on 8 September 2022 clarifying the intent and application of the provisions contained in the Compact, Affirming that the rules of customary international law, international conventions regulating treaties, Nepal Treaty Act, 2047 (1990) and Treaty Conclusion Directives, 2077 (2020) allow Nepal to make declarations to specify or clarify the meaning or scope attributed to a treaty or to certain provisions of treaties, Nepal declares as follows:

1. With reference to the Compact, Nepal declares that by being a Party to the Compact, Nepal shall not be bound by any of United States’ strategic, military or security alliance including the Indo-Pacific Strategy.

१. कम्प्याक्टको सम्बन्धमा, कम्प्याक्टको पक्ष भएको कारण नेपाल संयुक्त राज्य अमेरिकाको ईन्डो-प्यासेफिक स्ट्राटेजी (Indo-Pacific Strategy) लगायतको कुनै पनि सामरिक, सैन्य वा सुरक्षा गठबन्धनमा (alliance) बाँधिएको मानिने छैन भन्ने घोषणा गर्दछ ।

2. With reference to Section 2.7, Section 5.2 (b) (iii), Section 5.2 (b) (iv) of the Compact, Nepal understands that these sections are intended to only for the use of the MCC Funding and that the provisions do not and shall not obligate Nepal to comply with current or future United States’ laws or policies for any purpose other than the use of the MCC Funding.

२. कम्प्याक्टको दफा २.७, दफा ५.२(ख)(३). दफा ५.२(ख)(४) को सम्बन्धमा कम्प्याक्टको उक्त दफाहरुको उद्देश्य एमसीसी अनुदानको उपयोग सन्दर्भमा मात्र लागु हुन्छ भन्ने बुझाई नेपालको रहेको छ र उक्त प्रावधानले एमसीसी अनुदानको प्रयोग बाहेक अन्य कुनै नीतिहरुको पालना गर्न नेपाल बाध्य छैन भन्ने घोषणा गर्दछ । पनि उदेश्यका लागि हाल विद्यमान् वा भविष्यमा निर्माण हुने अमेरिकी कानून वा नीतिहरुको पालना गर्न नेपाल बाध्य छैन भन्ने घोषणा गर्दछ ।

3. With reference to Section 3.2 (b) of the Compact, Nepal declares that the conduct of activities of Millennium Challenge Account Nepal Development Board (the “MCA Nepal”) will be regulated by the laws of Nepal and the Compact.

३. कम्प्याक्टको दफा ३.२ (ख) को सम्बन्धमा, मिलेनियम च्यालेञ्ज एकाउण्ट नेपाल विकास समिति (“एमसीए-नेपाल) ले संचालन गर्ने क्रियाकलाप नेपालको कानूनद्वारा निर्देशित र कम्प्याक्ट अनुसार नियमित हुनेछ भन्ने घोषणा गर्दछ।

4. With reference to Section 3.2 (1) of the Compact, Nepal declares that MCC shall not have ownership over the Intellectual Property and that Nepal shall own and can fully enjoy all the Intellectual Property created under the Compact program.

४. कम्प्याक्टको दफा ३.२ (च) को सम्बन्धमा, कम्प्याक्टको दफा ३.२ (च) अनुसारको बौद्धिक सम्पत्ति माथि एमसीसीको स्वामित्व रहने छैन र कम्प्याक्ट कार्यक्रम अन्तर्गत सिर्जना हुने सम्पूर्ण बौद्धिक सम्पत्तिहरु उपर नेपालको स्वामित्व रहने छ र त्यसको पूर्ण उपभोग नेपालले गर्ने छ भन्ने घोषणा गर्दछ

5. With reference to Section 3.5 of the Compact, Nepal declares that Implementation Letters shall be implemented within the scope of the Compact.

५. कम्प्याक्टको दफा ३.५ को सम्बन्धमा, कार्यन्वयन पत्रहरु कम्प्याक्टको दायारा भित्र लागु गरिनेछ भन्ने घोषणा गर्दछ।

6. With reference to Section 3.8 (a) of the Compact, Nepal declares that the audits of all activities and funds of MCA-Nepal shall also be conducted by Office of the Auditor General in accordance with the prevailing laws of Nepal.

६. कम्प्याक्टको दफा ३.८ (क) को सम्बन्धमा, एमसिए-नेपालको सबै गतिविधि तथा कोषको लेखा परिक्षण प्रचलित नेपाल कानून बमोजिम महालेखा परिक्षकबाट पनि गरिने छ भन्ने घोषणा गर्दछ।

7. With reference to Section 5.1 (a) of the Compact, Nepal declares that Nepal has the right to terminate the Compact or MCC Funding by giving thirty (30) days’ prior written notice if the Compact or the activities/program under the Compact violate Nepal’s laws or policies.

७. कम्प्याक्टको दफा ५.१ (क) को सम्बन्धमा कम्प्याक्ट वा कम्प्याक्ट अन्तर्गतका गतिविधि/कार्यक्रमहरुले नेपालको कानून वा नीतिहरुको उल्लङ्घन गरेमा नेपालले तीस (३०) दिनको पुर्व लिखित सूचना दिएर कम्प्याक्ट वा एमसीसी अनुदान रकम खारेज गर्ने अधिकार नेपालसँग रहेको घोषणा गर्दछ।

8. With reference to Section 5.5 of the Compact, Nepal declares that provisions under the Compact which survive after the expiration, suspension or termination Compact will be relevant illustratively to the use of MCC Funding which remains outstanding including for evaluation of the projects under the Compact, audits and settlement of taxes.

८. कम्प्याक्टको दफा ५.५ (ग) को सम्बन्धमा कम्प्याक्टको समाप्ति, निलम्बन वा अन्त्य पश्चात पनि लागु हुने भनिएका प्रावाधनहरु बाँकी रहेको एमसीसी अनुदान रकमको उपयोग लगायत कम्प्याक्ट अन्तर्गतका परियोजनाहरुको मूल्याङ्कन, लेखापरीक्षण र करको फर-फराकको हद सम्म प्रासंगिक हुने घोषणा नेपाल गर्दछ।

9. With reference to Section 7.1 of the Compact, Nepal declares that the Constitution of Nepal shall prevail over the Compact and further declares that the Compact and the programs/projects under the Compact shall be implemented by complying with the laws of Nepal and in accordance with the Compact.

९. कम्प्याक्टको दफा ७.१ को सम्बन्धमा नेपालको संविधान कम्प्याक्ट भन्दा माथि रहने छ भन्ने घोषण गर्दछ । साथै कम्प्याक्ट र कम्प्याक्ट अन्तर्गतका कार्यक्रमहरु/परियोजनाहरुको कार्यान्वयन नेपालको कानून र कम्प्याक्ट बमोजिम गरिनेछ भन्ने घोषणा गर्ने

10. With reference to Section 8.1 of the Compact, Nepal declares that the Electricity Transmission Project including all movable and immovable assets including lands associated with the Project shall be owned by Government of Nepal or entities of Government of Nepal.

१०. कम्प्याक्टको दफा ८.१ को सम्बन्धमा विद्युत प्रसारण आयोजना (electricity transmission project) लगायतका साबै चल तथा अचल सम्पत्तिहरु, आयोजनासँग सम्बन्धित जग्गाहरु नेपाल सरकार वा नेपाल सरकारका निकायहरुको स्वामित्वमा रहने घोषणा गर्दछ ।

11. With reference to the letter received by Nepal from the Millennium Challenge Corporation on 8 September 2022, Nepal understands the responses in that said letter of Millennium Challenge Corporation shall aid in the interpretation and implementation of the Compact.

११. नेपालले मिति २०७८/५/२३ मा मिलेनियम च्यालेन्ज कर्पोरेशनबाट प्राप्त पत्रको सम्बन्धमा उक्त पत्रमा रहेको मिलेनियम च्यालेन्ज कर्पोरेशनको जवाफले कम्प्याक्टको व्याख्या तथा कार्यन्वयनमा मद्द्त गर्ने बुझाई नेपालको रहेको छ। प्रितिनिधि सभाबाट जारी भएको व्यख्यात्मक घोषणा
